1. About these terms

In shortThese terms apply whenever you buy anything from us, whether a fragrance, an experience or a course. Please read them before you order.

Thank you for visiting experimentalperfumeclub.com. Please read the following information carefully before using the site. Your use of the site, and any purchase you make through it, constitutes acceptance of these terms.

We may modify these terms from time to time. Continuing to use the site after any change means you accept the revised terms, so please review them regularly. If you do not agree with them, please stop using the site.

1.1 What these terms cover

These are the terms and conditions on which we supply products to you, whether goods, services or digital content, together referred to as Products. They may be supplemented from time to time by Additional Terms. Where the Additional Terms conflict with these Terms, the Additional Terms prevail.

1.2 Why you should read them

These terms tell you who we are, how we will provide Products to you, how you and we may change or end the contract, what to do if there is a problem, and other important information. If you think there is a mistake in these terms, please contact us.

1.3 If you are shopping from outside the United Kingdom

These terms are governed by the law of England and Wales. If you are a consumer resident in the European Union or elsewhere, this does not remove the protections given to you by the mandatory consumer law of your own country, which continue to apply.

2.1 Who we are

We are Experimental Perfume Club Ltd, a company registered in England and Wales under company number 10305110, with its registered office at 53 Monmouth Street, London WC2H 9DG. Experimental Perfume Club Ltd is the seller for all orders placed through this website, wherever in the world you are.

Experimental Perfume Club SAS, 250 bis Boulevard Saint-Germain, 75007 Paris, France (SIRET 91801772400017, VAT FR84918017724), is our European entity and acts as the Responsible Person for our cosmetic products placed on the European Union market. It is not a party to your contract of sale.

2.3 How we may contact you

If we need to contact you, we will do so by telephone or in writing, at the email or postal address you gave us with your order. Where we use the words writing or written in these terms, this includes email.

3. Our contract with you

In shortThe email you get straight after checkout confirms we have your order, not that we have accepted it. We accept when we dispatch your fragrance, or when we confirm your experience booking. If we cannot fulfil your order, we will tell you and refund you in full.

3.1 Placing your order

When you complete checkout, we will send you an order confirmation by email. This confirms that we have received your order and taken payment. It is an acknowledgement, not an acceptance.

3.2 When we accept your order

Our acceptance takes place, and a contract comes into existence between you and us:

  • for fragrances and other goods, when we email you to confirm that your order has been dispatched
  • for experiences, courses and other services, when we email you to confirm your booking
  • for digital content, when we make it available to you to download or stream

Where an order contains more than one item, we accept each item as it is dispatched or confirmed, and a separate contract is formed for each.

3.3 If we cannot accept your order

If we are unable to accept all or part of your order, we will tell you in writing and refund you in full for anything we cannot supply. This might be because a Product is out of stock, because an experience has reached capacity, because we have identified an error in the price or description, because we cannot meet a delivery deadline you have specified, because we are unable to ship to your address, or because we suspect fraud or a breach of these terms.

3.4 Your order number

We will assign an order number to your order and include it in your confirmation email. Please quote it whenever you contact us about your order.

3.5 Age requirements

You must be 18 or over to purchase from this website, and all participants in our experiences must be aged 18 or over.

4. Our products

In shortColours and packaging may vary slightly from the images on our site. Everything we sell is for your own use, not for resale.

4.1 What we sell

These terms apply to the sale of bespoke and non-bespoke fragrance products, and to the sale and provision of experiences, vouchers, courses, whether in person or digital, and perfumery equipment.

4.2 Products may vary slightly from their pictures

Images on our website are for illustrative purposes. Although we have made every effort to display colours accurately, we cannot guarantee that your device displays them faithfully, and your Product may vary slightly. Packaging may also vary from the images shown.

4.3 Fragrance is personal

The content delivered through our Products, experiences and courses is for informational, educational and enjoyment purposes. A fragrance created by a participant during an experience, or using our products, may not always suit personal taste. The level of one-to-one guidance varies depending on the product or experience chosen.

4.4 Personal use only

Any products and services we provide, including any perfume you create during an experience or course, are for personal use only. You may not sell or re-sell them. We reserve the right, with or without notice, to cancel or reduce the quantity of any order we believe may result in a breach of these terms.

4.5 Safety during experiences

We ask all participants to read and agree to our safety requirements before joining an experience. These can be found in our Health & Safety policy, and reminders are given on the day before the session begins.

5. Fragrance safety, allergens and skin sensitivity

In shortOur fragrances are cosmetic products for external use on skin. If you have sensitive skin or a known fragrance allergy, please check the ingredients and patch-test before regular use.

5.1 External use only

Our fragrances are cosmetic products intended for external use on the skin. They are not to be ingested. Please keep them away from the eyes, out of reach of children, and away from heat and open flame. Discontinue use if irritation occurs.

5.2 Allergens and ingredients

Perfume contains natural and synthetic materials, some of which are recognised allergens. A full ingredient list, including declarable allergens, is shown on each product page and printed on the packaging of every fragrance we sell. If you have sensitive skin or a known fragrance allergy, please review the ingredient list before purchase and test on a small area of skin before regular use.

5.3 Fragrances created during an experience

A fragrance you create during an experience is blended by you from materials we supply, and we will tell you what those materials are. You are responsible for telling us in advance of any allergy or sensitivity so that we can advise on the materials used. We cannot be responsible for a reaction to a fragrance you have composed where a relevant allergy or sensitivity was not disclosed to us.

5.4 Product compliance

Our fragrances comply with the UK Cosmetics Regulation and, where placed on the European Union market, with EU Regulation 1223/2009 on cosmetic products. A safety assessment is held for every product we sell, and products are notified to the relevant authorities before being placed on the market.

Experiences

6. Experiences and the Blending Atelier

In shortYou have 14 days to cancel a booking, unless your session is within 14 days of ordering. After that, experiences are non-refundable but can be rescheduled once, with enough notice. Please arrive on time.

6.1 Cancelling a booking

You have 14 days from the date of your order to cancel an experience booking. Where you book less than 14 days before the session takes place, you acknowledge that there is no right of cancellation.

6.2 Rescheduling

Past the cancellation period, experiences are non-refundable but may be rescheduled. We require between 24 and 72 hours notice before your scheduled session, depending on the experience booked. Please see the terms for your specific experience. Where notice is given, you have 3 months from the date of your original session to rebook. An experience may be rescheduled once.

6.3 Once an experience has taken place

You have no right to cancel or to a refund once a service has been fully performed. If you cancel after we have started providing a service but before it is complete, you must pay for the part supplied up to that point.

6.4 Arriving late

Sessions begin on time, so please arrive promptly. Where possible we will bring you into a session that has already started, though you may have missed an essential part of it. For one-to-one appointments, lateness may result in a shorter session. Refunds are not available in these circumstances.

6.5 If you do not attend

If you do not attend a booked session and did not cancel or contact us to rearrange beforehand, the contract will end and no refund will be available.

6.6 If we need to cancel or reschedule

We may need to suspend or cancel an experience to deal with technical problems, to reflect changes in law, if there are issues with the venue, or if the perfumer due to lead the session is unwell or unable to attend. We will contact you in advance wherever possible, and you may either rebook or receive a full refund of any sums paid in advance.

6.7 Group and corporate bookings

We offer experiences to business and group customers. The price per person is based on group size and quoted individually. All prices quoted for corporate experiences exclude VAT. Full payment is required in line with the invoice issued before the session takes place. The price is based on the number of participants confirmed at the time of booking and will not be adjusted for drop-outs or non-attendance.

6.8 Property and the venue

We are not responsible for any property belonging to you or to any other participant that is placed, deposited or left at the venue, unless we have been negligent. You are responsible for any loss or damage you cause to our property or to the property of the venue, and the cost of repair or replacement may be invoiced to you.

7. Gift vouchers

In shortVouchers last 12 months, are non-refundable, and can only be used for the experience they were bought for. Book at least 30 days before they expire.

7.1 Validity

Experience vouchers are valid for 12 months from the date of purchase and may be redeemed only against the specific experience for which they were purchased. They cannot be exchanged for cash or used as general credit.

7.2 Refunds and booking

Gift vouchers are non-refundable. Bookings made using a gift voucher should be made at least 30 days before the end of the validity period. Vouchers cannot be redeemed outside their validity period and will become invalid.

Orders, delivery and returns

8. Made-to-order and personalised perfumes

In shortPerfumes made specifically for you cannot be returned or cancelled once we have started blending, unless something is wrong with them.

8.1 What counts as made-to-order

Made-to-order Products include personalised perfumes, reorders of a fragrance you created during an experience, and any Product made to your specification. They are hand-blended for you in London and dispatched from the United Kingdom.

8.2 No right to change your mind

Because they are made specifically for you, made-to-order and personalised Products cannot be returned or refunded once we have begun making them. This does not affect your rights if a Product is faulty or misdescribed, which are set out in section 13.

8.3 Accuracy of what you tell us

Where we make a Product for you based on details you provide, you are responsible for ensuring that those details are correct.

9. Pre-orders and advance purchases

In shortSometimes you can order a fragrance before it is ready. We take payment at checkout, tell you when we expect to ship, and refund you in full if we cannot deliver it.

9.1 What a pre-order is

From time to time we offer a fragrance or other Product for pre-order before it is available to ship. Where we do, the expected dispatch window is shown on the product page at the time you order.

9.2 Payment and acceptance

Payment for a pre-order is taken at checkout. As with any other order, we accept your order when we dispatch it, and a contract is formed at that point.

9.3 If the date moves

Expected dispatch windows are estimates. If production is delayed we will email you with a revised date, and you may either wait or cancel your pre-order for a full refund. If we are unable to supply the Product at all, for example because of a production or quality issue, we will tell you and refund you in full within 14 days.

9.4 Changing your mind

You may cancel a pre-order at any time before dispatch for a full refund. Once the Product has been dispatched, your right to change your mind is the same as for any other order and is set out in section 11.

10. Delivery

In shortCosts and delivery times are set out on our Delivery & Returns page. Address changes are only possible within 30 minutes of ordering. Customs delays are outside our control.

10.1 Delivery costs and times

Delivery costs and estimated transit times are shown at checkout and set out in full on our Delivery & Returns page. Transit times are indicative and run from dispatch. Once an order has been placed the shipping option cannot be changed.

10.2 Changing your delivery address

If you need to change your delivery address, please contact us within 30 minutes of placing your order. After that we may be unable to make changes, as your order will already have been dispatched.

10.3 Delays outside our control

If delivery is delayed by an event outside our control, we will take reasonable steps to minimise the effect of the delay and will not be liable for it. If there is a risk of a delay of more than 8 weeks, you may contact us to end the contract and receive a refund for any Products paid for but not received.

This includes delays caused by customs. Couriers give delivery estimates, but customs authorities work independently and have no obligation to meet them. Neither we nor the courier can influence how long clearance takes.

10.4 Cancellation while in transit

It is not possible to cancel an order while it is in transit. Any cancellation, refund or replacement will be actioned once the Product has been received and returned. For orders outside the United Kingdom, the European Union and the United States, please allow up to 40 days from dispatch before we can process a cancellation, refund or replacement.

10.5 Duties and taxes

For orders delivered to the United Kingdom, the European Union and the United States, all taxes and duties are included at checkout and there is nothing to pay on delivery. For all other destinations, local customs duties and import taxes are payable by you.

10.6 Collecting your order

If you have asked to collect your order from us, you may do so during our opening hours of 12pm to 6pm, weekdays and Saturdays, excluding public holidays.

10.7 If you are not at home

If nobody is available to take delivery and the Products cannot be left safely, the courier will leave a note explaining how to rearrange delivery or collect from a local depot. If you do not rearrange delivery or collect the Products, we will contact you for instructions and may charge you for storage and any further delivery costs.

10.8 When the Product becomes your responsibility

A Product becomes your responsibility from the time it is delivered to the address you gave us, or collected by you. You own a Product once we have received payment in full.

11. Returns, changing your mind and refunds

In shortYou have 30 days to change your mind on unopened fragrances. UK returns are free. Returns from the EU and US are at your cost, and we cannot accept returns from anywhere else. Refunds are made within 14 days of receiving your return.

11.1 Your right to change your mind

For most Products bought online you have a legal right to change your mind within 30 days of receiving them and to receive a refund, under the Consumer Contracts Regulations 2013. For experiences booked in store, this period is 14 days. Fragrances must be returned unopened, unused, with tamper seals intact.

11.2 When you cannot change your mind

You do not have the right to change your mind in respect of:

  • Products made to your specification or personalised for you, including made-to-order perfumes and blend reorders
  • digital Products, once you have begun to download or stream them
  • experiences, once these have been completed or the booked date has passed, even if the cancellation period is still running
  • Products sealed for health protection or hygiene reasons, once unsealed after delivery
  • gift vouchers
  • Products which have become mixed inseparably with other items, or which have been used or damaged by you after delivery

11.3 A free sample with your full-size fragrance

Where a 50ml fragrance is supplied with a matching sample, you may return the unopened 50ml within 30 days of delivery if the sample does not suit you. UK returns are free. Returns from outside the UK are at your cost.

11.4 Telling us you want to return something

Please always email contact@experimentalperfumeclub.com with your order number before returning anything. Fragrance is classified as a dangerous good for transport and must be returned by specific methods. We cannot be responsible for returns arranged without our instructions, for example through a third-party shipping company.

11.5 Who pays for the return

United Kingdom: returns are free. We will email you a prepaid returns label to print at home, which you can drop at any Royal Mail or DPD Pickup point. Please keep your proof of postage.

European Union and United States: returns are at your cost. Fragrance must travel by road or ground service only, never by air, and must be returned in its original outer packaging so that the required transport labels remain visible. Parcels sent without them may be held or destroyed in postal checks and cannot be refunded. Please always use a tracked service and send us the tracking number.

Everywhere else: we are unable to accept returns from outside the UK, EU and US, because air transport regulations do not permit fragrance to be returned by air and there is no ground alternative. This does not affect your rights if a Product is damaged or faulty, which are set out in section 13.

Where a Product is faulty or misdescribed, or where you are ending the contract because of something we have done wrong, we will pay the costs of return wherever you are.

11.6 Sending your return back

If you are exercising your right to change your mind, you must send the goods back within 30 days of telling us. Returns are sent to the address we give you when you contact us, which depends on where your order was shipped from. UK returns are sent to:

11.7 When we will refund you

We will refund you to your original payment method within 14 days of receiving your return, or, if earlier, within 14 days of you providing evidence that you have sent it back. All returned goods are inspected. For reasons of hygiene we cannot refund opened or used fragrance.

11.8 Deductions from refunds

We may reduce your refund to reflect any reduction in the value of the goods caused by handling them beyond what would be permitted in a shop. Where we refund delivery costs, the maximum refunded is the cost of the least expensive delivery method we offer. Where the Product is a service, we may deduct an amount in proportion to the part of the service already supplied. Return postage costs are not refundable, except where the Product is faulty or misdescribed.

11.9 Model cancellation form

You do not have to use this form, but you may if you wish. Email it to contact@experimentalperfumeclub.com or post it to Experimental Perfume Club Ltd, 53 Monmouth Street, London WC2H 9DG.

12. Ending the contract for other reasons

In shortIf we change something significant, get the price wrong, or make a serious mistake, you can end the contract and we will refund you in full.

12.1 When you can end the contract and be refunded in full

You may end the contract immediately and receive a full refund for any Products not provided, and you may also be entitled to compensation, if:

  • we have told you about an upcoming change to the Product or these terms which you do not agree to
  • we have told you about an error in the price or description and you do not wish to proceed
  • there is a risk that supply may be significantly delayed because of events outside our control
  • we have suspended, or told you we will suspend, supply for technical reasons for more than 30 days
  • you have a legal right to end the contract because of something significant we have done wrong

12.2 Our right to end the contract

We may end the contract by writing to you if you do not make a payment when due and still do not pay within 7 days of a reminder, if you do not provide information we need within a reasonable time, or if you do not allow us to deliver the Products or collect them within a reasonable time. If we end the contract for these reasons we will refund any money paid in advance for Products not provided, but may charge reasonable compensation for the costs we incur.

12.3 Changes we may make

We may change a Product to reflect changes in relevant laws and regulatory requirements, or to make minor technical adjustments and improvements, for example to address a change in fragrance legislation.

13. If there is a problem with your order

In shortIf something arrives damaged, faulty or wrong, tell us and we will put it right at no cost to you, wherever you are.

13.1 How to tell us

13.2 Your legal rights

We are under a legal duty to supply Products that conform with this contract. Nothing in these terms affects your legal rights in relation to Products that are faulty or misdescribed, including your right under the Consumer Rights Act 2015 to reject faulty goods within 30 days of delivery.

13.3 Damaged or faulty Products

Where a Product is damaged, faulty or not what you ordered, we will arrange a replacement or a full refund at no cost to you, wherever you are in the world and whether or not the Product has been opened. This applies even to made-to-order perfumes and to orders that cannot otherwise be returned. We will pay the costs of return or collection.

13.4 Complaints and dispute resolution

If you are unhappy with a Product, an experience, or the service you have received, please email contact@experimentalperfumeclub.com. We will acknowledge your complaint within 2 working days and aim to resolve it within 14 days, keeping you informed if we need longer.

We do not currently subscribe to an alternative dispute resolution scheme. If we cannot resolve your complaint between us, you retain the right to bring a claim in the courts, as set out in section 19.

Price, payment and other terms

14. Price and payment

In shortThe price shown at checkout includes VAT. We accept the major cards, PayPal and Klarna. If we get a price wrong, we will contact you before charging you.

14.1 Where to find the price

The price of a Product, which includes VAT, is the price shown on the order pages when you place your order. Payment can be taken in pounds sterling, euros and US dollars.

14.2 If the rate of VAT changes

If the rate of VAT changes between your order date and the date we supply the Product, we will adjust the VAT you pay, unless you have already paid in full before the change takes effect.

14.3 If we have got the price wrong

If a Product's correct price is lower than the price stated, we will charge the lower amount. If it is higher, we will contact you for instructions before accepting your order.

14.4 When and how you must pay

We accept Visa, Mastercard, American Express, PayPal, Klarna and the digital wallets offered at checkout, including Apple Pay, Google Pay and Shop Pay. Payment is taken at checkout. For goods, your order is accepted when we dispatch it, and anything we cannot supply is refunded in full. For experiences and other services, full payment is required before we begin providing them. For group and corporate bookings, payment is due in line with the invoice issued.

14.5 Klarna

Klarna is an independent payment provider. By selecting Klarna at checkout you agree to their terms and conditions, and to your personal data being shared with Klarna to assess eligibility and manage your payment. Klarna's options are subject to status, available only to those aged 18 or over, and a soft credit check may be performed. Any questions about a Klarna payment or instalment should be directed to Klarna.

14.6 Late payment

If you do not pay by the due date we may charge interest on the overdue amount at 2% a year above the base lending rate of Barclays Bank plc, accruing daily. We will not charge interest on an invoice you have told us promptly that you believe to be wrong, until the issue is resolved.

15. Discount codes and promotions

In shortDiscount codes work on full-price items only, must be used at checkout, and cannot be added to an order afterwards.

Discount codes are valid on full-priced items only and cannot be applied to sale items, gift vouchers or bundled sets, unless expressly stated otherwise. Codes must be entered at checkout and cannot be applied retrospectively to past orders. Unless otherwise specified, promotional codes and discount offers cannot be used in conjunction with any other offer, and do not apply to delivery charges. Any refund will take into account the discount applied. We reserve the right to decline an order where, in our reasonable opinion, a code is invalid or is being used fraudulently, and to change these terms or withdraw a promotion on reasonable notice.

16. Our responsibility for loss or damage

In shortWe are responsible for foreseeable loss we cause, and we never limit our liability where the law does not allow us to. Our Products are for personal use, so we are not liable for business losses.

16.1 Loss we are responsible for

If we fail to comply with these terms we are responsible for loss or damage you suffer that is a reasonably foreseeable result of our breaking this contract or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable.

16.2 Liability we never exclude

We do not exclude or limit our liability in any way where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or that of our employees, agents or subcontractors, for fraud or fraudulent misrepresentation, for breach of your legal rights in relation to the Products, and for defective products under the Consumer Protection Act 1987.

16.3 Business losses

We supply our Products for domestic and private use only. If you use them, or any technique learnt during an experience, for any commercial, business or resale purpose, we will have no liability to you for loss of profit, loss of business, business interruption or loss of business opportunity.

16.4 Your own fault

We are not responsible for loss or damage you suffer as a result of your own fault or negligence.

16.5 Your responsibility to us

You agree to indemnify us against any claims, losses, damages and reasonable costs, including legal fees, arising from your breach of these terms, or from your use of our Products or of any technique learnt during an experience for a commercial, business or resale purpose. This does not affect your rights as a consumer.

16.6 Links to other websites

Our website may contain links to websites operated by others. We do not control those websites, are not responsible for their content, products or privacy practices, and their inclusion does not imply our endorsement.

17. Intellectual property

In shortOur name, fragrances, formulations, recipes and content belong to us. The perfume you create with us is yours to wear, but not to copy, produce or sell.

17.1 Our rights

All intellectual property rights in the Experimental Perfume Club name and marks, our fragrance names, our formulations and recipes, our packaging and design, and all content on this website, including text, photography, video, audio and course materials, are and remain our exclusive property or that of our licensors.

17.2 Fragrances created during an experience

A fragrance you create during an experience or course is yours to wear and enjoy. The underlying formulation, method and materials remain our intellectual property. You may not reproduce, manufacture, commercialise or sell that fragrance, or any fragrance derived from it, whether yourself or through a third party.

17.3 Use of our content

You may use our content only as we expressly permit. Reproduction, redistribution or commercial use of our content, in whole or in part, is prohibited without our written consent.

18. Your personal information

In shortWe use your details to fulfil your order and, if you have opted in, to send you news. You can unsubscribe at any time.

We use the personal information you give us to supply the Products to you, to process your payment, and, where you have agreed to it, to send you news and updates about our fragrances and experiences. You may opt out at any time using the unsubscribe link in any email, or by contacting us. We give personal information to third parties only where the law requires or allows us to do so. Please see our Privacy & Cookie Policy for further detail.

19. Other important terms

In shortStandard legal housekeeping: we may transfer this agreement, the rest of it survives if one part fails, and English law applies.

19.1 Transferring this agreement

We may transfer our rights and obligations under these terms to another organisation. We will tell you in writing if this happens and will ensure it does not affect your rights under the contract. You may transfer your rights or obligations to another person only if we agree in writing.

19.2 Nobody else has rights under this contract

This contract is between you and us. No other person has any right to enforce its terms.

19.3 If part of this contract is found to be unlawful

Each paragraph of these terms operates separately. If any court decides that any of them is unlawful, the remaining paragraphs remain in full force.

19.4 Delay in enforcing these terms

If we do not insist immediately that you do something you are required to do under these terms, or delay in taking steps against you, that does not prevent us from doing so at a later date.

19.5 Governing law

These terms are governed by the law of England and Wales, and you may bring legal proceedings in the courts of England and Wales. If you live in Scotland, you may bring proceedings in either the Scottish or the English and Welsh courts. If you live in Northern Ireland, you may bring proceedings in either the Northern Irish or the English and Welsh courts. If you are a consumer resident in the European Union, this does not remove the protections given to you by the mandatory consumer law of your own country.

19.6 Other policies
